Payment, Cancellation, Refund & Dispute Policy
Rules for paid collaborations when payment functionality is enabled.
Scope and beta status
This Policy applies to paid collaborations processed through Create in Baltics when payment functionality is enabled. Payment and payout features may be limited or unavailable during beta. If no Platform payment is taken, this Policy does not create a payment guarantee.
Pricing
Current beta pricing: Creator Platform fee 0%; Brand Platform fee 10% on top of the agreed Creator price. Taxes or third-party payment charges may apply where legally required and will be shown when applicable.
Payment secured
Where the workflow shows “Payment secured”, the relevant Brand payment has been received or confirmed through the payment provider for the collaboration workflow. This wording does not mean Create in Baltics is a licensed escrow service, bank or deposit institution.
When a Creator is paid
Subject to payment-provider requirements, fraud/chargeback checks and any bona fide dispute, Creator payout is released after the collaboration reaches the Platform approval/completion stage specified for that collaboration.
A payout may be delayed where identity verification is incomplete, a payment is reversed, a dispute is open, or law requires us or the payment provider to pause the transfer.
Cancellation before collaboration confirmation
Before both Creator and Brand confirm the collaboration, either side may withdraw unless the Platform clearly states otherwise. If a payment was taken before confirmation and no paid work has started, the Brand should receive a refund of the collaboration amount, subject to any non-refundable payment-provider charges that the law permits us to retain.
Cancellation after confirmation
After both sides confirm, cancellation depends on the work already performed, products shipped or received, non-recoverable expenses, deadlines and the specific campaign terms. The parties should first attempt to agree a fair cancellation amount in the Platform conversation.
Create in Baltics may consider evidence of completed work and documented costs when deciding what amount, if any, should be released or refunded through the Platform.
Creator non-delivery
If a Creator fails to provide the agreed deliverables without an agreed extension or valid reason, the Brand may open a dispute and request a refund. We may request the brief, messages, deadlines and evidence of performance before deciding the Platform payment outcome.
Brand revision or approval disputes
Brands may request only revisions within the agreed scope. A refund is not automatically due because a Brand changes its creative preference after delivery. Likewise, a Creator is not required to provide materially new deliverables for free.
Defective or unusable deliverables
If delivered content materially fails the agreed brief, the Creator should first be given a reasonable opportunity to correct it where correction is possible and within scope. If the failure cannot reasonably be corrected, a full or partial refund may be appropriate depending on the circumstances.
Product shipping and expenses
Shipping costs, product-return obligations, travel and production expenses should be stated in the campaign. A refund decision may take documented non-recoverable expenses into account.
Chargebacks
A Brand should use the Platform dispute process before initiating an unjustified payment chargeback. Fraudulent or abusive chargebacks may lead to account restriction and recovery of resulting costs where lawful.
How to open a dispute
Use the Platform dispute/support function where available or email info@createinbaltics.com as soon as possible. Include the campaign name, parties, amount, what happened, the outcome requested and relevant evidence.
Platform review
We may review the brief, messages, submitted files, revision history, payment records and other relevant evidence. We may facilitate a settlement or make a reasonable decision about the Platform-controlled payment flow. This does not prevent a party from pursuing legal rights that cannot be waived.
Refund timing
Approved refunds are sent through the original payment method where possible. Bank and payment-provider processing times are outside our control.
Platform fees
Whether the Brand Platform fee is refunded depends on the reason for cancellation/refund, whether the Platform service was already performed, non-recoverable payment costs and applicable law. The outcome will be shown or communicated in the specific case.
No waiver of mandatory rights
Nothing in this Policy limits rights or remedies that applicable law does not allow the parties to waive.
