Platform Terms of Use
Terms governing access to and use of the Create in Baltics marketplace.
Who we are
Create in Baltics (the “Platform”) is an online marketplace available at createinbaltics.com that helps content creators and brands in Latvia, Lithuania and Estonia discover each other, communicate, agree collaborations and, where enabled, manage payments and delivery.
Acceptance and eligibility
By creating an account, accessing a workspace, publishing a campaign, applying to a campaign or otherwise using the Platform, you agree to these Terms and any role-specific terms that apply to you.
- You must be at least 18 years old.
- You must provide accurate and current information.
- If you use the Platform for a company, brand or other organisation, you confirm that you are authorised to bind that organisation.
- The Platform is intended for professional or commercial collaborations, not personal household use.
Our role
Create in Baltics provides marketplace and workflow technology. Unless expressly stated otherwise in a specific transaction, we are not the creator, brand, employer, employee, agent, talent manager, advertising agency, buyer or seller of the content services.
A collaboration contract is formed directly between the Creator and the Brand when both sides confirm the collaboration or otherwise accept the specific campaign terms. We facilitate the process but do not guarantee that a user will receive applications, be selected, complete a collaboration, achieve marketing results, or remain available.
Accounts and profiles
Users are responsible for account security and for activity performed through their account. You must not share passwords or authentication credentials. Public profile information may include professional name, location, languages, niches, portfolio, service packages, pricing and other information chosen for marketplace discovery. Private legal, tax and payout information must not be placed in public profile fields.
Campaigns, applications and collaborations
Brands may publish campaigns containing deliverables, budget, deadline, usage rights, language, location, revisions, shipping or product information and other requirements. Creators may apply to campaigns. Unless the Platform specifically provides another mechanism, an application is an expression of interest and does not itself create a paid collaboration.
When both sides confirm a collaboration, the agreed campaign terms become part of the contract between the Brand and Creator. Users should review all deliverables, deadlines, usage rights, fees and revision terms before confirming.
Fees and pricing
During the current beta pricing model, Creators are charged a 0% Platform fee and Brands are charged a 10% Platform fee on top of the agreed Creator price. Example: if the Creator price is EUR 100, the Brand price is EUR 110 before any taxes or payment charges that may lawfully apply.
We may change fees prospectively. Any new fee will be shown before the relevant paid transaction or announced before it applies. Changes do not retroactively alter an already confirmed collaboration.
Payments and payouts
Payment and payout functionality may be introduced or limited during beta. Where payment functionality is enabled, payments may be processed through Stripe or another disclosed payment service provider. Their terms and identity-verification requirements may also apply.
The phrase “Payment secured” means that the Platform has received or obtained confirmation of the relevant payment through the payment provider and is holding or controlling the workflow for later payout under the collaboration terms. It does not mean that Create in Baltics is a licensed escrow provider, bank or deposit institution.
Creators remain responsible for their own taxes, registration, invoicing obligations and reporting. Brands remain responsible for any taxes and accounting obligations applicable to their purchase.
Content delivery, revisions and approval
Creators must deliver the agreed content in accordance with the campaign brief. Brands must review submissions in good faith and may request revisions only within the agreed revision scope. A request for materially different deliverables is a new request and may require additional compensation.
Completion, approval, revision and payout statuses shown in the Platform are workflow records. No automatic approval period applies unless it is specifically shown in the collaboration details.
Intellectual property and usage rights
Unless a campaign expressly states otherwise, the Creator retains copyright in original content. After the Brand has paid all agreed amounts, the Brand receives the usage licence specifically agreed in the campaign, including any agreed channels, territory, paid advertising rights, duration, raw-footage rights and exclusivity.
No broader transfer, perpetual licence, paid-advertising right, whitelisting right or exclusivity is granted merely because content was delivered. Users must record special usage rights in the campaign or collaboration terms.
User responsibilities
- Do not post illegal, fraudulent, discriminatory, misleading or unsafe campaigns or content.
- Do not impersonate another person or business.
- Do not upload material you do not have the right to use.
- Do not make unsubstantiated product, health, financial or other regulated claims.
- Do not misuse personal data obtained through the Platform.
- Do not attempt to bypass security, scrape private data, introduce malware or interfere with Platform operation.
- Do not use the Platform solely to obtain a marketplace introduction and then deliberately conceal the resulting collaboration to avoid an applicable Platform fee.
Moderation and account restrictions
We may remove content, pause a campaign, restrict features, suspend or terminate an account when reasonably necessary to protect users, comply with law, investigate suspected fraud or abuse, enforce these Terms, or protect Platform security. Where appropriate and legally required, we will provide reasons and a way to contact us about the decision.
Reviews, ratings and badges
If ratings, reviews or badges are enabled, they may only be based on genuine Platform activity and must be honest and relevant. We may remove manipulated, abusive or misleading reviews. A badge or rating is not a guarantee of quality, identity, future performance or legal compliance.
Third-party services
The Platform may rely on third-party services such as payment processors, hosting, storage, authentication, email delivery and analytics. We are not responsible for independent third-party services outside our control, but we select and use providers subject to applicable law and our Privacy Policy.
Availability and beta status
The Platform may be released as a beta product. Features may change, be added, removed or temporarily unavailable. Feed, events, payments, ratings or other features marked as “Coming Soon”, beta or unavailable should not be treated as active services.
Disclaimers and liability
To the maximum extent permitted by law, the Platform is provided on an “as available” basis. We do not guarantee commercial results, creator performance, brand performance, the legality of user-provided claims, or uninterrupted availability.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct or other liability that applicable law requires us to retain. Subject to those mandatory rules, we are not liable for indirect or consequential business losses arising from a Creator-Brand contract that we are not a party to.
Complaints and disputes
Users should first contact info@createinbaltics.com. Collaboration disputes may be handled under the Payment, Cancellation, Refund & Dispute Policy. We may request evidence such as the campaign brief, messages, files, delivery records and payment records.
Changes to these Terms
We may update these Terms to reflect product, legal or operational changes. Material changes will be communicated appropriately. The version in effect when a collaboration is confirmed will normally govern that collaboration, except where a change is required by law.
Governing law
These Terms are governed by the laws of the Republic of Latvia, subject to any mandatory rights or jurisdiction rules that cannot lawfully be excluded. Courts or competent authorities in Latvia will have jurisdiction where legally permitted.
